Under the New York Surrogate’s Court Procedure Act §2307 (“SCPA”), executor fees are based on the value of the probate estate and range between 2% and 5% of the value of applicable assets received and paid out. Higher fees can be ordered by a court in special circumstances and for more complicated cases.
